Human Performance Consulting, founded and operated by Dr. Linda Yarick, has developed a body of proprietary intellectual property over three decades of practice — including the Guided Growth™ model, a family of organizational assessment instruments, published works, and the frameworks, language, and methodology that appear throughout this website.
This Notice identifies what is protected, explains the legal basis on which each category is protected, describes what you may and may not do with it, and sets out how licensed use is granted to clients, pilot participants, and event hosts.
This Notice works alongside our Copyright Notice, Terms of Use, and Disclaimer. Where a signed engagement, licensing, or pilot agreement grants you rights beyond those described here, that agreement controls for that engagement.
All intellectual property appearing on or associated with this Site is owned by Dr. Linda Yarick and/or Human Performance Consulting, except third-party materials identified in Section 9.
Nothing on this Site transfers ownership of any intellectual property to any user. Access to the Site, participation in a consultation, attendance at a keynote or workshop, purchase of a book, or participation in an assessment pilot conveys no ownership interest whatsoever.

Marks also claimed in the logo, wordmark, site iconography, and the distinctive taglines and phrases used to identify our services in commerce, including "Bridging the Gap Between Potential and Performance," "Aligning People. Culture. Systems.," and "Insight · Alignment · Action · Impact."
The ™ symbol indicates a mark in which we claim rights arising from use in commerce. It does not indicate federal registration. Use of our marks is prohibited without prior written permission, including in advertising, service descriptions, course or workshop titles, certification claims, domain names, social media handles, search engine keyword bidding, metadata, or any use that suggests affiliation, sponsorship, endorsement, accreditation, or certification by Human Performance Consulting where none exists.
Limited nominative use is permitted. You may refer to us by name — for example, to state accurately that your organization engaged Human Performance Consulting, to cite the Guided Growth™ model in an article, or to review one of Dr. Yarick's books — provided the reference is truthful, uses no more of the mark than necessary, does not alter the mark, and does not imply endorsement.
The following are proprietary to Human Performance Consulting and are protected through a combination of trademark, copyright in their expression, trade secret in their unpublished components, and contract:
How this protection actually operates. United States copyright law does not protect ideas, systems, methods, or procedures as such — it protects the particular expression of them. Accordingly, we do not claim to own the general concepts of systems thinking, organizational alignment, or emotional intelligence, which are part of the shared professional literature. What we do own, and will enforce, is: the specific written and visual expression of our frameworks; the names under which they are offered in commerce; the confidential scoring logic, item banks, weighting, interpretive rules, norming data, and validation methodology underlying our assessments; and the contractual terms on which any of it is licensed.
Our assessment instruments and the Organizational Intelligence Assessment System™ are currently in validation and development. Their item banks, scales, scoring algorithms, weighting schemes, interpretive frameworks, benchmark and norming data, reporting templates, and validation methodology constitute confidential information and trade secrets and are protected under applicable trade secret law, including the Defend Trade Secrets Act, 18 U.S.C. §1836 et seq., and applicable state law.
Any person or organization granted access — whether through a pilot, an early-access program, a client engagement, or otherwise — receives access under a separate written agreement and may not:

The Site's written content — including Insights articles, service descriptions, About and SAP page copy, principle statements, taglines, and headline language — together with its visual design, layout, typography, colour system, iconography, diagrams, photography, logo, and downloadable materials, is protected. Detailed copyright terms, permitted quotation, and takedown procedures are addressed in our Copyright Notice.
Books authored by Dr. Yarick, including Guided Growth: Emotional Recovery Workbook, are protected by copyright. Rights in published works may be shared with a publisher or distributor under separate agreement.
The free sample chapter offered on the Site is provided for personal reading only. It may not be reproduced, redistributed, posted, emailed in bulk, resold, translated, adapted, recorded, or incorporated into training materials, curricula, course packs, treatment programs, or derivative works. Workbook pages, exercises, and worksheets may not be photocopied for group, classroom, program, or organizational use without a written reprint or bulk-use licence.
8.1 Site visitors. You may view the Site, and may print or download individual pages for your own personal, non-commercial reference. All other rights are reserved.
8.2 Clients. Materials we deliver in an engagement — reports, frameworks, tools, workbooks, slide decks, diagnostic outputs — are licensed to the client organization for its internal use only, for the purposes described in the engagement, unless the engagement agreement expressly says otherwise. Unless separately agreed in writing, clients may not: use our frameworks or materials to deliver consulting, coaching, or training to third parties; incorporate them into products or services offered commercially; distribute them outside the organization; use them after termination other than for internal historical reference; or remove proprietary notices.
8.3 Assessment pilot participants. Pilot access is governed exclusively by the pilot agreement. Absent one, no licence is granted by any statement on this Site or by any conversation about early access.
8.4 Event hosts. Booking a keynote, workshop, or training session licenses live delivery to the agreed audience only. Recording, streaming, photographing slides, transcribing, redistributing, or reusing presentation materials requires prior written permission and is typically addressed in the speaking agreement. Handouts are licensed to attendees for personal use.
8.5 Media and press. Journalists, podcast hosts, and event promoters may use Dr. Yarick's approved biography, headshot, book cover image, and speaker description for the purpose of covering or promoting her work, unaltered and with attribution. Interview and article content remains subject to the Copyright Notice.
8.6 Feedback. If you send us suggestions, ideas, or improvements — about the Site, an assessment, a framework, or a book — you grant us a perpetual, worldwide, royalty-free right to use them without obligation, attribution, or compensation. Please do not send confidential or third-party-owned material you are not free to share.
9.1 Federal materials. References to 49 CFR Part 40, FMCSA regulations, the Drug and Alcohol Clearinghouse, and DOT guidance describe federal law and federal systems. Those materials are not ours, and our use of them implies no endorsement, sponsorship, certification, or affiliation by the U.S. Department of Transportation, FMCSA, or any federal agency. "Substance Abuse Professional" and "SAP" describe a regulatory role defined by federal regulation; they are not proprietary to us.
9.2 Professional credentials. ICADC and related credential designations are the property of the certifying bodies that issue them and are used to describe qualifications held.
9.3 Platforms and vendors. Amazon, Calendly, WordPress, LinkedIn, and other names and logos appearing on the Site belong to their respective owners.
9.4 Client marks. Client names, logos, and marks — where used with permission — remain the property of those organizations.
9.5 Third-party content. Where the Site quotes, cites, or reproduces third-party material, it is used with permission or under fair use, with attribution. If you believe your material has been used improperly, see Section 12.

We monitor use of our marks and content and will pursue available remedies for infringement, misappropriation of trade secrets, breach of licence, false designation of origin, and unfair competition — including injunctive relief, damages, and attorneys' fees where available.
