02 Works Covered by This Notice

This Notice applies to, without limitation:

  • Written content on the Site — the About, Consulting, SAP, Books, Speaking, and Assessments pages; service descriptions; the Guiding Principles as articulated; headline and tagline copy; compliance explanations; and all navigational and interstitial text
  • Insights articles and any other blog, newsletter, or editorial content, including titles, subheadings, and structure
  • Books and workbooks authored by Dr. Linda Yarick, including Guided Growth: Emotional Recovery Workbook — text, exercises, worksheets, reflection prompts, sequencing, forewords, and cover design
  • The free sample chapter offered through the Site

03 Ownership and Authorship

Unless expressly stated otherwise, all works identified in Section 2 are authored by Dr. Linda Yarick and owned by Dr. Linda Yarick and/or Human Performance Consulting.

Commissioned works. Website design, photography, illustration, and editorial contributions produced by contractors are used under written assignment or licence. Where a contractor retains rights, use of that material is limited accordingly.

Published works. Books and workbooks may be subject to publishing, distribution, or platform agreements under which certain rights — print, digital, audio, translation, or territorial — are shared with or licensed to a publisher or retailer. Requests concerning published works may need to be directed to the publisher; we will say so if that is the case.

Guest and contributed content. Any guest article, foreword, testimonial, or quoted contribution remains the property of its author and is published here under licence.

04 What Copyright Protects — and What It Does Not

Copyright protects the expression of ideas, not the ideas themselves. Under 17 U.S.C. §102(b), copyright does not extend to any idea, procedure, process, system, or method of operation.

Accordingly, we do not claim copyright ownership of general concepts such as systems thinking, organizational alignment, psychological safety, or emotional intelligence, which belong to the shared professional literature and to which many practitioners have contributed.

What we do own and enforce is the specific expression: our particular wording, our diagrams and their visual arrangement, our sequencing and structure, our examples and case narratives, and our written articulation of the Guided Growth™ model and its component frameworks.

The names under which these frameworks are offered, and their confidential mechanics, are protected separately — see our Intellectual Property Notice.

05 Permitted Uses

5.1 Personal use. You may read, print, and save individual pages or articles for your own personal, non-commercial reference, retaining all proprietary notices.

5.2 Quotation and citation. You may quote brief excerpts from Site content or published works for the purposes of commentary, criticism, news reporting, scholarship, or research, consistent with fair use, provided that:

  • the quotation is brief relative to the source — as a working guideline, no more than approximately 200 words from a single article or 300 words from a book, and never a complete article, chapter, exercise, worksheet, framework listing, or figure;
  • the quotation is accurate and in context, with no alteration of meaning;
  • attribution is included in the form set out in Section 11;
  • where published online, the citation includes a live link to the original page;
  • the use does not substitute for the original or serve as the substance of your own commercial offering.

5.3 Academic and educational use. Instructors and researchers may quote and cite our work under the terms above. Reproducing complete articles, chapters, worksheets, or figures in course packs, learning management systems, or institutional repositories requires written permission — which we grant readily for genuine educational purposes and usually at no charge.

5.4 Media use. Journalists, podcast producers, and event organizers may quote Dr. Yarick's published work with attribution and may use her approved biography, headshot, and book cover image for coverage or event promotion.

5.5 Client internal use. Deliverables provided in an engagement may be reproduced and circulated within the client organization for the purposes of that engagement, with notices intact. External distribution, commercial use, or use as the basis of the client's own consulting, coaching, or training offering requires written permission.

06 Prohibited Uses

Without prior written permission, you may not:

  • reproduce, republish, mirror, syndicate, or post any article or substantial portion of Site content on another website, newsletter, intranet, social platform, or publication;
  • reproduce complete chapters, exercises, worksheets, or workbook pages for group, classroom, program, treatment, or organizational use;
  • photocopy, scan, or distribute workbook material to participants, clients, patients, or employees in bulk;
  • create derivative works — adaptations, translations, abridgements, summaries offered as substitutes, worksheets, slide decks, training curricula, or "based on" materials;
  • record, stream, live-transcribe, or photograph slides at a keynote, workshop, or training session, or redistribute any recording;
  • rehost or hotlink images, diagrams, or downloadable files;
  • present our written expression as your own work, or as the foundation of a competing consulting, coaching, assessment, or publishing offering;
  • remove, obscure, crop out, or alter any copyright, attribution, or proprietary notice;
  • sell, licence, or monetize any portion of our content, including behind a paywall, membership, or course platform.

07 Republication and Syndication of Insights Articles

We welcome sharing and are generally glad to say yes to republication requests — but permission must be granted in advance and in writing.

Always permitted without asking: linking to an article; sharing a link on social media; quoting a short excerpt with attribution and a link under Section 5.2.

Requires written permission: full-text republication, newsletter reprints, intranet posting, translation, inclusion in an anthology or edited volume, adaptation into a different format, and syndication to aggregators or content platforms.

Where we grant republication, we typically require unaltered text, a clear byline for Dr. Linda Yarick, a canonical link back to the original article, and a statement that the piece originally appeared on guidedgrowthleadershipmodel.com.

08 Books, Workbooks, and Reprint Permissions

Books and workbooks are sold through third-party retailers, including Amazon. Purchase conveys a licence to read the copy purchased — nothing more. It does not convey the right to reproduce, distribute, adapt, perform, or display the work.

Workbook material warrants specific mention. Guided Growth: Emotional Recovery Workbook contains exercises and worksheets designed for individual use. Counselors, treatment programs, employers, facilitators, and group leaders may not photocopy or digitally reproduce pages for participants. Bulk purchase or a written reprint licence is required. This is not a technicality — reproducing recovery workbook material for group programs without a licence is one of the most common infringements of works of this kind.

We offer bulk purchase arrangements, site licences, and reprint permissions. Please ask; the terms are usually straightforward.

Audiobook content may not be re-recorded, excerpted into podcasts, or redistributed.

09 User Contributions

If you submit a comment, testimonial, review, question, or other content to the Site or to us:

  • you retain ownership of your submission;
  • you grant Human Performance Consulting a non-exclusive, perpetual, worldwide, royalty-free, sublicensable licence to use, reproduce, adapt, excerpt, and display it in connection with our business, including in marketing materials, on the Site, and in future publications;
  • you represent that the submission is your own, that you have the right to grant this licence, and that it does not infringe anyone's rights or disclose confidential or personal information about a third party;
  • you agree not to submit health, testing, employment, or violation information about yourself or anyone else.

Testimonials appearing on the Site are published with permission and are presented at role level rather than by name. If you have given a testimonial and wish to withdraw it, contact us and we will remove it from materials within our control.

10 Reservation of Rights Against Text and Data Mining and AI Training

We expressly reserve all rights in our content with respect to text and data mining, web scraping, dataset compilation, and the training, fine-tuning, grounding, retrieval-augmentation, or evaluation of artificial intelligence, machine learning, or generative systems.

No content on this Site or in our published works may be used for any of those purposes without prior express written permission. This reservation is made pursuant to applicable law, including Article 4(3) of EU Directive 2019/790 and comparable provisions in other jurisdictions, and is intended to be effective as a machine-readable and human-readable reservation.

Automated access for the purpose of building training corpora is prohibited and may also violate our Terms of Use.

12 Copyright Infringement — DMCA Notice and Takedown

12.1 If you believe your work has been infringed on this Site. We respect the rights of others and will respond promptly to properly submitted notices under the Digital Millennium Copyright Act, 17 U.S.C. §512.

Send written notice to our Designated Agent, including all of the following:

  • 1. a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • 2. identification of the copyrighted work claimed to have been infringed;
  • 3. identification of the material claimed to be infringing, with enough detail — ideally the URL — for us to locate it;
  • 4. your name, mailing address, telephone number, and email address;

12.2 Counter-notification. If material you posted was removed and you believe the removal was mistaken or the result of misidentification, you may submit a counter-notice containing your signature, identification of the removed material and its former location, a statement under penalty of perjury that you have a good faith belief the removal was a mistake, your contact information, and consent to the jurisdiction of the federal district court for your district (or, if outside the United States, any district in which we may be found).

12.3 Misrepresentation. Under 17 U.S.C. §512(f), knowingly and materially misrepresenting that material is infringing — or that it was removed by mistake — may result in liability for damages, including costs and attorneys' fees.

12.4 Repeat infringers. We will terminate access and remove content, in appropriate circumstances, for users who are repeat infringers.

13 Requesting Permission

We say yes more often than people expect — especially for educational, nonprofit, and journalistic uses. Please include:

  • the specific material you wish to use, with URL or page numbers;
  • how, where, and for how long it will be used;
  • the audience, distribution size, and whether the use is commercial;
  • whether the material will be altered, translated, or excerpted;
  • your name, organization, and contact information.

Allow reasonable time for a response. Permission granted for one use is not permission for any other, and permission may be conditioned on attribution, format, term, or fee.

14 Enforcement and Reservation of Rights

All rights not expressly granted are reserved. We monitor for unauthorized use and pursue available remedies, which may include takedown demands, platform reports, injunctive relief, actual damages and profits, statutory damages, and attorneys' fees where available under 17 U.S.C. §504 and §505.
